Does anyone really believe that in 25 plus years, OCR has always
successfully negotiated compliance. If so, every state would be in
compliance by now, having recognized a precedence that OCR would
insist on compliance.
        The idea that OCR has always negotiated voluntary compliance and
that's why it has not terminated funding sure seems out of sync with
my experience. To me it has always looked more like Washington has not
backed up findings of noncompliance at the regional level so the
regions are left to try to back out and still save face - and settle
for less than compliance. I think it has been a matter of politics at
the national level that has resulted in no withholding of funds.
