As usual Kristen is on target with comments regarding Title IX and
athletics. Proportionality is only one prong of a three-pronged test.
Schools that comply with one of the three prongs will be found by OCR to be
in compliance with Title IX. Hence, some schools either demonstrate a
history of expansion of offerings to the previously-underserved group or
that demonstrate that the needs of students regarding athletics
participation are being met (through surveys of need or desire to
participate) may be found in compliance. There are 10 areas within the
athletics program that OCR looks at: equipment and supplies comparability;
scheduling of games and practice times; travel and per diem allowance;
opportunity to receive coaching and academic tutoring; assignment and
compensation of coaches and tutors; provision of locker rooms, practice and
competitive facilities; provision of medical and training facilities and
services; provision of medical and training facilities and services; and,
publicity. Schools that understand their obligations to provide equitable
programming know that "what is good for the goose is good for the gander"
and act accordingly.
